The references of harmonised standards for machinery drafted in support of Directive 2006/42/EC listed in Annex I of this Decision are hereby published in the Official Journal of the European Union . The references listed in rows 121, 266, 343, 405 and 495 of that Annex are published with restrictions.

(1) In accordance with Article 7 of Directive 2006/42/EC machinery manufactured in conformity with a harmonised standard, the reference to which has been published in the Official Journal of the European Union , is to be presumed to comply with the essential health and safety requirements covered by such a harmonised standard.
(2) By letter M/396 of 19 December 2006 , the Commission made a request to the European Committee for Standardization (CEN) and the European Committee for Electrotechnical Standardization (Cenelec) (the Request) for the drafting, the revision and the completion of the work on harmonised standards in support of Directive 2006/42/EC to take account of changes introduced by that Directive in comparison with Directive 98/37/EC of the European Parliament and of the CouncilDirective 98/37/EC of the European Parliament and of the Council of 22 June 1998 on the approximation of the laws of the Member States relating to machinery (OJ L 207, 23.7.1998, p. 1 ). .

(8) The Commission together with CEN and Cenelec has assessed whether the standards drafted, revised and amended by CEN and Cenelec comply with the Request.
(9) The harmonised standards drafted, revised and amended by CEN and Cenelec on the basis of the Request, except for harmonised standard EN ISO 11850:2011 with EN ISO 11850:2011/A1:2016 and EN ISO 11850:2011/A2:2022, satisfy the safety requirements which they aim to cover and which are set out in Directive 2006/42/EC.
(10) Having examined the standard EN ISO 11850:2011 with EN ISO 11850:2011/A1:2016 and EN ISO 11850:2011/A2:2022 together with the representatives of Member States and stakeholders in the Machinery Expert Group, the Commission concluded that the standard fails to meet the essential health and safety requirements set out in points 1.1.6, 1.5.15 and 1.6.2 of Annex I to Directive 2006/42/EC, namely the requirement concerning accommodating the variability of the operator's physical dimensions, the requirement that parts of the machinery where persons are liable to move about or stand must be designed and constructed in such a way as to prevent persons slipping, tripping or falling on or off these parts, and the requirement that machinery must be designed and constructed in such a way as to allow access in safety to all areas where intervention is necessary during operation, adjustment and maintenance of the machinery. In particular, the standard includes a derogation to allow a first access step height of up to 700 mm instead of 550 mm on wheeled skidders and wheeled feller-bunchers, but it does not address appropriate ergonomic principles and safe access, which in some cases may lead to slipping, tripping or falling of persons.
(11) It is therefore appropriate to publish the references of those standards, with restriction where relevant, in the Official Journal of the European Union , together with references of any relevant amending or correcting standards thereto.
(12) The references of harmonised standards drafted in support of Directive 2006/42/EC are currently published in Communication 2018/C 092/01 and Commission Implementing Decision (EU) 2019/436.
(13) In the interests of clarity and rationality, a complete list of references of harmonised standards drafted in support of Directive 2006/42/EC and satisfying the requirements they aim to cover should be published in a single act.
(14) The references of harmonised standards published in Annex I to Implementing Decision (EU) 2019/436, as well as those published in Communication 2018/C 092/01, should be published in a new consolidated Annex to this Decision.
(15) Moreover, Annexes II and IIA to Implementing Decision (EU) 2019/436 list the specific references of harmonised standards that are published with restrictions, whereas such restrictions are not published separately in the Communication 2018/C 092/01. In the interests of clarity and rationality, references of harmonised standards published with restrictions should be published in a new consolidated Annex to this Decision. Any references in Annexes II and IIA that have exhausted their effects should be omitted.
(16) The references of harmonised standards listed in Annex III to Implementing Decision (EU) 2019/436, as well as those in the fifth column of the Communication 2018/C 092/01, have been withdrawn from the Official Journal of the European Union as from the dates set out in the respective tables.
(17) As the result of the work by CEN and Cenelec on the basis of the Request, several harmonised standards published in the C series of the Official Journal of the European Union have been replaced, revised or amended, as is also the case for those published in Annex I to Implementing Decision (EU) 2019/436. It is therefore necessary to also withdraw the references of those standards from the Official Journal of the European Union and set the dates of withdrawal.
(18) In the interests of clarity and rationality, references of harmonised standards that have been withdrawn should be published in a separate new consolidated Annex to this Decision. Any references with withdrawal dates before the entry into force of this Decision are no longer relevant and should be omitted.
(19) In order to give manufacturers sufficient time to prepare for the application of the new standards, revised standards or amendments to standards, it is necessary to defer the withdrawal of the references of those harmonised standards, as appropriate.
(20) Many of the references of harmonised standards published by Communication 2018/C 092/01 have already been withdrawn by Implementing Decision (EU) 2019/436.
(21) In the interests of clarity and rationality, both Communication 2018/C 092/01 and Implementing Decision (EU) 2019/436 should be repealed. In order to give manufacturers sufficient time to adapt their products to the revised versions of the standards concerned, Communication 2018/C 092/01 and Implementing Decision (EU) 2019/436 should continue to apply to the relevant standards for a transitional period.
(22) Compliance with a harmonised standard confers a presumption of conformity with the corresponding essential requirements set out in Union harmonisation legislation from the date of publication of the reference of such standard in the Official Journal of the European Union . This Decision should therefore enter into force on the date of its publication,
Communication 2018/C 092/01 is repealed.
However, it shall continue to apply to the references of harmonised standards listed in Annex II to this Decision until the dates of withdrawal of those references set out in that Annex.

Implementing Decision (EU) 2019/436 is repealed.
However, it shall continue to apply to the references of harmonised standards listed in Annex III to this Decision until the dates of withdrawal of those references set out in that Annex.
