Having regard to the approval of the Council,

The Agreement between the European Union and the European Atomic Energy Community, of the one part, and the Swiss Confederation, of the other part, on the participation of the Swiss Confederation in Union ProgrammesThe text of the Agreement (not yet published in the Official Journal). is hereby approved on behalf of the European Atomic Energy Community, as regards matters falling under the Euratom Treaty.

(1) By DecisionCouncil Decision approving the conclusion, by the European Commission, on behalf of the European Atomic Energy Community, of the Agreement between the European Union and the European Atomic Energy Community, of the one part, and the Swiss Confederation, of the other part, on the participation of the Swiss Confederation in Union Programmes (not yet published in the Official Journal). , the Council approved the conclusion, by the European Commission, on behalf of the European Atomic Energy Community, of the Agreement between the European Union and the European Atomic Energy Community, of the one part, and the Swiss Confederation, of the other part, on the participation of the Swiss Confederation in Union Programmes (the Agreement), including its provisions on provisional application, as regards matters falling under the Treaty establishing the European Atomic Energy Community (the Euratom Treaty).

(2) The Agreement should be concluded on behalf of the European Atomic Energy Community, as regards matters falling under the Euratom Treaty. The conclusion should take place at the same time as the conclusion of the other elements of the broad package of measures related to bilateral relations with the Swiss Confederation and as an integral part of that package.

(3) The Agreement should be applied provisionally by the European Atomic Energy Community, pending its entry into force, as regards matters falling under the Euratom Treaty.

(4) The signing, provisional application and conclusion of the Agreement, as regards matters falling under the Treaty on the Functioning of the European Union, is subject to a separate procedure, under that Treaty,

Following its signature, and subject to reciprocity, the Agreement shall be applied provisionally in accordance with its Article 18.
