THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive 2003/87/EC of the European Parliament and of the Council of 13 October 2003 establishing a system for greenhouse gas emission allowance trading within the Union and amending Council Directive 96/61/ECOJ L 275, 25.10.2003, p. 32 , ELI: http://data.europa.eu/eli/dir/2003/87/oj. , and in particular Article 3gf(2), point (b), thereof,

The Annex to Implementing Decision (EU) 2024/411 is replaced by the text set out in the Annex to this Decision.

(1) Commission Implementing Decision (EU) 2024/411Commission Implementing Decision (EU) 2024/411 of 30 January 2024 on the list of shipping companies specifying the administering authority in respect of a shipping company in accordance with Directive 2003/87/EC of the European Parliament and of the Council (OJ L, 2024/411, 31.1.2024, ELI: http://data.europa.eu/eli/dec_impl/2024/411/oj). establishes a list of shipping companies performing maritime transport activities within the scope of Article 3ga of Directive 2003/87/EC, which are attributed to Member States pursuant to Article 3gf of that Directive.

(2) To reflect any necessary changes to the list established by Implementing Decision (EU) 2024/411 and thus to maintain its accuracy and completeness, the Commission is to establish, pursuant to Article 3gf(2), point (b), of Directive 2003/87/EC, before 1 February 2026 , an updated list of shipping companies specifying their administering authorities.

(3) Such updated list should be established based on the latest data from Thetis-MRV on shipping companies that changed the Member State of registration within the Union or performed a maritime transport activity listed in Annex I to Directive 2003/87/EC that fell within the scope set out in Article 3ga of that Directive.

(4) In order to ensure that the updated attribution is aligned with the start of the compliance cycle, this Decision should apply from 1 January 2026 .

(5) The Annex to Implementing Decision (EU) 2024/411 should therefore be amended accordingly,

This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union .

The Decision shall apply from 1 January 2026 .
