THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive (EU) 2016/797 of the European Parliament and of the Council of 11 May 2016 on the interoperability of the rail system within the European UnionOJ L 138, 26.5.2016, p. 44 , ELI: http://data.europa.eu/eli/dir/2016/797/oj. , and in particular Article 5(11) and Article 48(2) thereof,

Implementing Regulation (EU) 2023/1695 is amended as follows:

The TSI shall not apply to existing trackside CCS and on-board CCS subsystems of the rail system already placed on the market and in service on all or part of any Member State’s railway network by 28 September 2023 , except when:

(a) the subsystem is subject to renewal or upgrading in accordance with point 7 of Annex I to this Regulation;

(b) the area of use of a vehicle is extended in accordance with Article 54(3) of Directive (EU) 2016/797 to at least three Member States, or the installation of ETCS is indicated in RINF for the subsequent five years in the new area of use. In that case point 7.4.2.3 of Annex I to this Regulation shall apply;

(c) the subsystem is subject to the specification maintenance requirements set out in point 7.2.10 of Annex I to this Regulation.

The technical and geographical scope of the TSI is set out in points 1.1 and 1.2 of Annex I.

Vehicles subject to paragraph 1 that require Class B on-board systems to circulate on routes only equipped with Class-B systems may be granted Union funds, if using options indicated in point 4.2.6.1(1) and (2) of Annex I, as well as, until 31 December 2040 , if using the option indicated in point 4.2.6.1(3) of Annex I.

Within 6 months following the publication in this TSI of the specific cases under Article 13(1), Member States concerned shall repeal all national rules concerning compatibility with train-detection systems, except for cases covered by Article 13(2)(f) of Directive (EU) 2016/797.

The Agency shall consider the economic and technical justification for specific cases of train detection systems defined in this regulation and their corresponding end dates, with the aim to improve the interoperability and technical harmonisation of the European railway system, at least once after each update of the National Implementation Plans. Based on it and whenever appropriate, the Agency shall address recommendations on the specific cases to the Commission.

(1) In accordance with Commission Delegated Decision (EU) 2017/1474Commission Delegated Decision (EU) 2017/1474 of 8 June 2017 supplementing Directive (EU) 2016/797 of the European Parliament and of the Council with regard to specific objectives for the drafting, adoption and review of technical specifications for interoperability (OJ L 210, 15.8.2017, p. 5 , ELI: http://data.europa.eu/eli/dec_del/2017/1474/oj). , the technical specifications for interoperability (TSIs) should be reviewed in order to take into account developments in the Union railway system relating to research and innovation activities, and integrate references to updated standards.

(2) The European Train Control System (ETCS) and Automated Train Operation (ATO) on-board units should be able to safely run on compliant ETCS and ATO lines with an acceptable level of performance. Trackside and on-board ETCS equipment based on Baseline 4 specifications and ATO equipment based on Baseline 1 specifications should be tested according to suitable new procedures. Therefore, the TSI relating to the control-command and signalling (CCS) subsystems should be amended to provide for new testing procedures.

(3) Commission Implementing Regulation (EU) 2023/1695Commission Implementing Regulation (EU) 2023/1695 of 10 August 2023 on the technical specification for interoperability relating to the control-command and signalling subsystems of the rail system in the European Union and repealing Regulation (EU) 2016/919 (OJ L 222, 8.9.2023, p. 380 , ELI: http://data.europa.eu/eli/reg_impl/2023/1695/oj). introduced the concept of a single set of specifications implementing three levels of functionalities for system versions 2.1, 2.2 and 3.0. This means that corrections to any specification errors need only be made once and will apply to all system versions covered by the text of the specifications. Implementing Regulation (EU) 2023/1695 only defines the functionalities of the most complete system version, i.e. version 3.0. Therefore, this TSI should be amended to provide for the detailed description of the functionalities of the two reduced system versions, i.e. versions 2.1 and 2.2.

(4) Implementing Regulation (EU) 2023/1695 provides for transitional measures in order to keep the railway sector competitive and prevent undue costs arising from changes made too frequently to the legal framework. Such transitional measures apply to contracts which are already underway and to projects at an advanced stage of development on the date of application of the relevant TSI. However, provisions relating to transition periods in points 7.2.4 and 7.4.1.2 and in Appendix B of Annex I to Implementing Regulation (EU) 2023/1695 may lead to varying interpretations. Application of the transition regimes set out in Appendix B of Annex I to Implementing Regulation (EU) 2023/1695 have proven that they are not extensive enough to prevent undue costs on the railway sector. Therefore, it is necessary to amend the provisions on transition regimes.

(5) Implementing Regulation (EU) 2023/1695 laid down provisions on the continuation of the obligations of the infrastructure managers in relation to ETCS system compatibility. However similar provisions in relation to radio system compatibility have not been included. Therefore, it is necessary to complement Implementing Regulation (EU) 2023/1695 with provisions on the continuation of the obligations of the infrastructure managers in relation to radio system compatibility.

(6) While changes to Implementing Regulation (EU) 2023/1695 and its Annexes are limited in scope they are large in number. Therefore it is appropriate to replace the annexes in their entirety.

(7) In order to avoid uncertainty, pursuant to Article 3(5), point (h), of Delegated Decision (EU) 2017/1474 each amended TSI is to indicate whether the conformity assessment bodies notified on the basis of a previous version of the TSI need to be re-notified, and whether a simplified notification process should be applied. The amendments introduced by this Regulation do not require specific new competences for the conformity assessment and therefore the conformity assessment bodies that were notified on the basis of previous versions of CCS TSI under Implementing Regulation (EU) 2023/1695 and Commission Regulation (EU) 2016/919Commission Regulation (EU) 2016/919 of 27 May 2016 on the technical specification for interoperability relating to the control-command and signalling subsystems of the rail system in the European Union (OJ L 158, 15.6.2016, p. 1 , ELI: http://data.europa.eu/eli/reg/2016/919/oj). do not need to be re-notified.

(8) On 19 December 2024 , European Union Agency for Railways (the Agency) issued a recommendation to amend Implementing Regulation (EU) 2023/1695 as regards the testing requirements for the new ETCS Baseline 4 specifications and ATO Baseline 1 specifications. In its recommendation, the Agency also provided for specifications defining ETCS Baseline 4 system versions 2.1 and 2.2, as well as making more precise provisions on transitional measures.

(9) Implementing Regulation (EU) 2023/1695 should therefore be amended accordingly.

(10) The measures provided for in this Regulation are in accordance with the opinion of the committee established in accordance with Article 51(1) of Directive (EU) 2016/797,

(1) Article 2 is amended as follows:(a) in paragraph 1, the second sentence is deleted;(b) paragraphs 2 and 3 are replaced by the following:2.The TSI shall not apply to existing trackside CCS and on-board CCS subsystems of the rail system already placed on the market and in service on all or part of any Member State’s railway network by 28 September 2023 , except when: (a) the subsystem is subject to renewal or upgrading in accordance with point 7 of Annex I to this Regulation;(b) the area of use of a vehicle is extended in accordance with Article 54(3) of Directive (EU) 2016/797 to at least three Member States, or the installation of ETCS is indicated in RINF for the subsequent five years in the new area of use. (2) in Article 8, paragraph 2 is replaced by the following:2.Vehicles subject to paragraph 1 that require Class B on-board systems to circulate on routes only equipped with Class-B systems may be granted Union funds, if using options indicated in point 4.2.6.1(1) and (2) of Annex I, as well as, until 31 December 2040 , if using the option indicated in point 4.2.6.1(3) of Annex I. ;

(5) Annex I is replaced by the text in Annex I to this Regulation;

(6) Annex II is replaced by the text in Annex II to this Regulation.

The CCS TSI amendments introduced by this Regulation do not require re-notification of conformity assessment bodies that were notified on the basis of previous versions of CCS TSI under Implementing Regulation (EU) 2023/1695 and Regulation (EU) 2016/919.
