The Commission approves the inclusion of Port Victoria in Mahé, located in the territory of the Republic of Seychelles, in the list of ports approved by Implementing Regulation (EU) 2025/897 for catches set out in Article 14(4), point (a), of the Regulation (EC) No 1224/2009 that are landed or transhipped unsorted.

That list was amended by adding new ports which comply with the relevant provisions of Chapter II of Commission Implementing Regulation (EU) 2024/1474Commission Implementing Regulation (EU) 2024/1474 of 24 May 2024 laying down rules for the application of Article 14(4), point (a), of the Council Regulation (EC) No 1224/2009 as regards derogation from the margin of tolerance in estimating catches for unsorted landings and transhipments from small pelagic, industrial and tropical tuna purse seiners fisheries (OJ L, 2024/1474, 27.5.2024, ELI: http://data.europa.eu/eli/reg_impl/2024/1474/oj). , approved by Commission Implementing Regulation (EU) 2025/2156Commission Implementing Regulation (EU) 2025/2156 of 24 October 2025 amending Implementing Regulation (EU) 2025/897 as regards the approval of the listing of ports in accordance with Chapter II of Implementing Regulation (EU) 2024/1474 (OJ L, 2025/2156, 27.10.2025, ELI: http://data.europa.eu/eli/reg_impl/2025/2156/oj). .

(2) In accordance with Article 6 of Implementing Regulation (EU) 2024/1474, France submitted an application to the Commission to include one port located in the territory of the Republic of Seychelles, namely Port Victoria in Mahé, in the list of ports approved by Implementing Regulation (EU) 2025/897 for unsorted landings and transhipments from tropical tuna purse seine fisheries.

(3) Based on the information and evidence submitted by France in its application and following an assessment carried out by the Commission as referred to in Article 7(1) of Implementing Regulation (EU) 2024/1474, the Commission found that the conditions set out in Chapter II of that Implementing Regulation for the port proposed to be listed have been fulfilled.

(4) According to the information submitted by France, Port Victoria meets the conditions required under Articles 4 and 5 of Implementing Regulation (EU) 2024/1474 for the listing of ports in third countries.

(5) Seychelles is a Contracting Party to the Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal Unreported and Unregulated FishingCouncil Decision 2011/443/EU of 20 June 2011 on the approval, on behalf of the European Union, of the Agreement on Port State Measures to Prevent, Deter and Eliminate Illegal, Unreported and Unregulated Fishing (OJ L 191, 22.7.2011, p. 1 , ELI: http://data.europa.eu/eli/dec/2011/443/oj). and Port Victoria is a designated port for landing activities within the framework of two regional fisheries management organisations, namely the Southern Indian Ocean Fisheries AgreementOJ L 196, 18.7.2006, p. 15 , ELI: http://data.europa.eu/eli/agree_internation/2006/496/oj. and the Indian Ocean Tuna CommissionOJ L 236, 5.10.1995, p. 25 , ELI: http://data.europa.eu/eli/agree_internation/1995/399/oj and Council Decision 95/399/EC of 18 September 1995 on the accession of the Community to the Agreement for the establishment of the Indian Ocean Tuna Commission (OJ L 236, 5.10.1995, p. 24 , ELI: http://data.europa.eu/eli/dec/1995/399/oj). . Furthermore, Seychelles is neither a country identified or notified of the possibility of being identified as a non-cooperating country in accordance with Chapter VI of Council Regulation (EC) No 1005/2008Council Regulation (EC) No 1005/2008 of 29 September 2008 establishing a Community system to prevent, deter and eliminate illegal, unreported and unregulated fishing, amending Regulations (EEC) No 2847/93, (EC) No 1936/2001 and (EC) No 601/2004 and repealing Regulations (EC) No 1093/94 and (EC) No 1447/1999 (OJ L 286, 29.10.2008, p. 1 , ELI: http://data.europa.eu/eli/reg/2008/1005/oj). , nor a country identified as allowing non-sustainable fishing pursuant to Article 4(1), point (a), of Regulation (EU) No 1026/2012 of the European Parliament and of the CouncilRegulation (EU) No 1026/2012 of the European Parliament and of the Council of 25 October 2012 on certain measures for the purpose of the conservation of fish stocks in relation to countries allowing non-sustainable fishing (OJ L 316, 14.11.2012, p. 34 , ELI: http://data.europa.eu/eli/reg/2012/1026/oj). .

(6) The port has in place procedures to ensure the accurate weighing of tropical tuna purse seine fisheries catches referred to in Article 14(4), point (a), of Regulation (EC) No 1224/2009, and to ensure that such weighing is carried out under the responsibility of independent third-party weighers, in accordance with the conditions laid down in Article 5(1) and (2) of Implementing Regulation (EU) 2024/1474.

(7) Based on the information submitted, the port proposed to be listed by France should therefore be approved and entered in the list of ports referred to in Article 14(6) of Regulation (EC) No 1224/2009.

(8) Implementing Regulation (EU) 2025/897 should therefore be amended accordingly,

The Annex to Implementing Regulation (EU) 2025/897 is amended in accordance with the Annex to this Regulation.
