THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2019/1242 of the European Parliament and of the Council of 20 June 2019 setting CO2 emission performance standards for new heavy-duty vehicles and amending Regulation (EC) No 595/2009 and (EU) 2018/956 of the European Parliament and of the Council and Council Directive 96/53/ECOJ L 198, 25.7.2019, p. 202 , ELI: http://data.europa.eu/eli/reg/2019/1242/oj. , and in particular Article 11(1), second subparagraph, thereof,

The reference CO2 emissions, referred to in Article 11(1), second subparagraph, of Regulation (EU) 2019/1242, of the vehicle sub-groups to which the reporting period of the year 2019 applies as reference periodare set out in the Annex to this Regulation.

(1) In order to make the reference CO2 emissions set out in Annex II to Commission Implementing Decision (EU) 2021/781Commission Implementing Decision (EU) 2021/781 of 10 May 2021 on the publication of a list indicating certain CO2 emissions values per manufacturer as well as average specific CO2 emissions of all new heavy-duty vehicles registered in the Union and reference CO2 emissions pursuant to Regulation (EU) 2019/1242 of the European Parliament and of the Council for the reporting period of the year 2019 (OJ L 167, 12.5.2021, p. 47 , ELI: http://data.europa.eu/eli/dec_impl/2021/781/oj). legally binding for manufacturers who were not addressees of that Decision as they only entered the Union market after the reporting period of the year 2019 by registering vehicles falling into the vehicle subgroups referred to in Annex II to that Decision, those reference CO2 emissions should be readopted in this Regulation.

(2) To determine the specific CO2 emissions targets and the CO2 emissions reduction trajectories, the reference CO2 emissions of the vehicle sub-groups to which the reporting period of the year 2019 applies as reference period should be based on the data reported under Regulation (EU) 2018/956 of the European Parliament and of the CouncilRegulation (EU) 2018/956 of the European Parliament and of the Council of 28 June 2018 on the monitoring and reporting of CO2 emissions from and fuel consumption of new heavy-duty vehicles (OJ L 173, 9.7.2018, p. 1 , ELI: http://data.europa.eu/eli/reg/2018/956/oj). ,

This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union .
