THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 194(2), in conjunction with Article 218(9) thereof,

Having regard to the proposal from the European Commission,

The position to be taken on the Union’s behalf in the 23rd meeting of the Ministerial Council of the Energy Community (the Ministerial Council) on 18 December 2025 shall be to approve the adoption of the acts as set out in the addendum to this Decision.

Council Decision 2006/500/EC of 29 May 2006 on the conclusion by the European Community of the Energy Community Treaty (OJ L 198, 20.7.2006, p. 15 , ELI: http://data.europa.eu/eli/dec/2006/500/oj).

(1) The Treaty establishing the Energy Community (the Energy Community Treaty) was concluded by the Union by Council Decision 2006/500/ECCouncil Decision 2006/500/EC of 29 May 2006 on the conclusion by the European Community of the Energy Community Treaty (OJ L 198, 20.7.2006, p. 15 , ELI: http://data.europa.eu/eli/dec/2006/500/oj). and entered into force on 1 July 2006 .

(2) Pursuant to Articles 47 and 76 of the Energy Community Treaty, the Ministerial Council of the Energy Community (the Ministerial Council) is to adopt measures taking the form of a decision or a recommendation.

(3) During its 23rd meeting on 18 December 2025 , the Ministerial Council is to adopt a number of acts which have legal effects and are therefore within the scope of Article 218(9) of the Treaty on the Functioning of the European Union. The purpose of the envisaged acts is to facilitate the achievement of the objectives of the Energy Community Treaty.

(4) As the representatives of the Union are to vote on the acts to be adopted by the Ministerial Council, it is appropriate to establish the position to be taken on the Union’s behalf within the Ministerial Council regarding those acts as set out in the addendum to this Decision,

Minor changes may be agreed by the Commission to the acts as set out in the addendum to this Decision, in the light of comments communicated by the Energy Community Treaty contracting parties before or at the meeting of the Ministerial Council, without a further decision of the Council.

If the Ministerial Council is not in a position to adopt the acts as set out in the addendum to this Decision at its meeting on 18 December 2025 , those acts may be adopted by correspondence following the 23rd meeting of the Ministerial Council, in accordance with the Rules of Procedure of the Ministerial Council, without a further decision of the Council.
