THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 91, in conjunction with Article 218(9), thereof,

Having regard to the proposal from the European Commission,

The position to be taken on the Union’s behalf at the next meeting of the Joint Committee established under Article 18(1) of the Protocol on the international regular and special regular carriage of passengers by coach and bus to the Interbus Agreement as regards the adoption of its Rules of Procedure shall be based on the draft Decision of the Joint Committee established under the Protocol attached to this Decision.

Council Decision 2002/917/EC of 3 October 2002 on the conclusion of the Interbus Agreement on the international occasional carriage of passengers by coach and bus (OJ L 321, 26.11.2002, p. 11 , ELI: http://data.europa.eu/eli/dec/2002/917/oj).

(1) The Interbus Agreement on the international occasional carriage of passengers by coach and bus (the Interbus Agreement) was concluded by the Union by Council Decision 2002/917/ECCouncil Decision 2002/917/EC of 3 October 2002 on the conclusion of the Interbus Agreement on the international occasional carriage of passengers by coach and bus (OJ L 321, 26.11.2002, p. 11 , ELI: http://data.europa.eu/eli/dec/2002/917/oj). and entered into force on 1 January 2003 .

(2) The Protocol on the international regular and special regular carriage of passengers by coach and bus to the Interbus Agreement (the Protocol) was concluded by the Union by Council Decision (EU) 2023/911Council Decision (EU) 2023/911 of 28 September 2021 on the conclusion, on behalf of the European Union, of a Protocol to the Agreement on the international occasional carriage of passengers by coach and bus (Interbus Agreement) regarding the international regular and special regular carriage of passengers by coach and bus (OJ L 122, 5.5.2023, p. 1 , ELI: http://data.europa.eu/eli/dec/2023/911/oj). and entered into force on 1 October 2024 .

(3) Pursuant to Article 18(1) of the Protocol, a Joint Committee (the Joint Committee established under the Protocol) is established.

(4) Pursuant to Article 23(3) of the Interbus Agreement, applicable by virtue of Article 18(2) of the Protocol, the Joint Committee established under the Protocol is to adopt its own Rules of Procedure.

(5) The Joint Committee established under the Protocol, during its next meeting, is to adopt a decision establishing its own Rules of Procedure.

(6) It is appropriate to establish the position to be taken on the Union’s behalf in the Joint Committee established under the Protocol, as the Decision to be adopted by that committee will be binding on the Union.

(7) The establishment of the Rules of Procedure of the Joint Committee established under the Protocol will facilitate the application of the Protocol. Such rules should correspond closely, with the necessary adaptations, to the Rules of Procedure of the Joint Committee established under the Interbus Agreement by Decision No 1/2011 of that committeeDecision No 1/2011 of the Joint Committee established under the Interbus Agreement on the international occasional carriage of passengers by coach and bus of 11 November 2011 adopting its rules of procedure and adapting Annex 1 to the Agreement regarding the conditions applying to road passenger transport operators, Annex 2 to the Agreement concerning the technical standards applying to buses and coaches and the requirements concerning the social provisions referred to in Article 8 of the Agreement (OJ L 8, 12.1.2012, p. 38 , ELI: http://data.europa.eu/eli/dec/2012/25(1)/oj). ,

Minor changes to the draft Decision of the Joint Committee established under the Protocol on the adoption of its Rules of Procedure may be agreed by the representatives of the Union at the Joint Committee established under the Protocol without further decision of the Council.
